Are you ready for the TSCA “Active” Inventory?

The TSCA “Active” inventory as a result of the TSCA Reset activities under the Lautenberg Chemical Safety Act for the 21st Century was announced on February 19, 2019. The “Active” inventory becomes effective 90 days after the signed action from the EPA. 

The EPA signed the action on May 6, 2019. The signature provides a date of August 5, 2019 as the official date that the “Active” inventory becomes effective. After August 5, 2019, it will be unlawful to manufacture, import or use a chemical not listed on the “Active” inventory for TSCA commercial purposes. Originally it was anticipated that 90 days after the February 19th release would be used as the effective date.

If a chemical is listed on the “Inactive” inventory, a Notice of Activity-B (NOA-B) must be filed with the EPA to transfer the chemicals to the “Active” inventory prior to use for TSCA commercial purposes.
